Please read these Terms of Service ("Terms") carefully before using the Assistly-AI platform. By accessing or using Assistly-AI, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, accessing, or using any part of Assistly-AI, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the platform. If you are using Assistly-AI on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
Assistly-AI is an AI-powered customer support automation platform that enables businesses to manage and automate customer conversations across multiple channels, including website live chat, Facebook Messenger, WhatsApp Business, Instagram Direct Messages, and Facebook comment responses. The service is provided on a subscription basis.
3. Acceptable Use Policy
You agree to use Assistly-AI only for lawful purposes and in accordance with these Terms. You are responsible for all content you provide, including the business information used to train the AI system and the conversations handled through your connected channels.
You agree that your use of the platform will at all times comply with applicable laws and regulations, including all data protection and privacy laws, as well as the terms and policies of any third-party platforms connected to your Assistly-AI account.
4. Prohibited Activities
You must not use Assistly-AI to:
- Violate any applicable law, regulation, or third-party rights
- Send spam, unsolicited messages, or engage in deceptive marketing practices
- Collect personal data without proper consent or in violation of applicable privacy laws
- Impersonate any person or entity or misrepresent your affiliation with any party
- Interfere with or disrupt the integrity or performance of the platform or its infrastructure
- Attempt to gain unauthorized access to any part of the platform or its related systems
- Violate Meta's Platform Terms, WhatsApp Business Policy, or any other third-party platform policy
- Distribute malicious software or content that is harmful, offensive, or illegal
5. AI Limitation Disclaimer
Assistly-AI uses artificial intelligence to generate automated responses. While we strive to provide accurate and helpful responses, AI-generated content may not always be accurate, complete, or appropriate for every situation. Assistly-AI does not guarantee the accuracy, reliability, or completeness of any AI-generated response. You are responsible for reviewing your AI configuration, training data, and response quality. You should not rely solely on AI responses for decisions involving legal, medical, financial, or other professional advice.
6. Account Suspension and Termination
We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, if we determine that you have violated these Terms, engaged in prohibited activities, or if your use of the platform poses a risk to other users, third parties, or the integrity of the service. Upon termination, your access to the platform will cease and your data will be subject to the retention and deletion terms described in our Privacy Policy.
7. Payment and Refund Terms
Assistly-AI is offered on a subscription basis. By subscribing to a paid plan, you agree to pay the applicable fees as described on our Pricing page. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. We do not offer refunds for partial subscription periods. If you believe you have been charged in error, please contact support@assistlyai.online within 14 days of the charge. All fees are exclusive of applicable taxes, which you are responsible for paying.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Assistly-AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, business interruption, or reputational harm, arising from your use of or inability to use the platform, regardless of whether such damages were foreseeable or whether we were advised of the possibility of such damages. Our total aggregate liability to you for any claims arising under these Terms shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction in which Assistly-AI operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of the applicable jurisdiction. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
